The right to practice before the IRS is regulated by Federal statute, and persons authorized to practice are known as "Federally Authorized Tax Practitioners” or FATPs. The United States Treasury grants FATP status to attorneys, CPAs, and Enrolled Agents (and to persons in a few other categories).

To become an Enrolled Agent, an applicant must pass the Special Enrollment Examination or present evidence of qualifying experience as an IRS employee. The Treasury conducts a background check of every applicant, which includes a review of the applicant’s tax compliance.

The National Association of State Boards of Accountancy (NASBA) serves as a forum for the 55 boards of accountancy within the United States, its territories and possessions.

The National Registry of CPE Sponsors is a program offered by NASBA to recognize CPE program sponsors who provide CPE programs in accordance with nationally recognized standards. The names of approved CPE program sponsors are published in a listing distributed throughout the country via the Internet and in printed format. State Boards of Accountancy and their licensees can refer to this listing to identify and select CPE program sponsors.

State law generally requires that CPAs have 40 hours of continuing professional education per year. Many states require that a certain number of CPE hours should be devoted to a particular topic, such as ethics or auditing. Generally, however, the CPA is free to choose the kind of CPE he or she wants to attend and the subject matter he or she is interested in.

The CPE year is the calendar or non-calendar year within which CPAs must complete their required continuing professional education. Many states have a calendar year CPE year, but other states have a CPE year ending on June 30, August 31, or on the basis of a CPA's birthday or licensing date.
